1. Agreement to Terms

By accessing or using the services of Jake @ Hardwired Visuals ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services

Jake @ Hardwired Visuals provides professional photography services including but not limited to:

Senior portrait photography
Family photography
Couple photography
Event photography
Related photography services

3. Booking and Payment

3.1 Booking: All photography sessions must be booked in advance. A booking is confirmed only upon receipt of a signed agreement and required deposit.

3.2 Payment: Payment terms will be specified in your booking agreement. Full payment may be required before the session or delivery of final images, as agreed upon.

3.3 Deposits: Deposits are non-refundable but may be applied to rescheduled sessions at our discretion, subject to availability.

4. Cancellation and Rescheduling

4.1 Client Cancellation: If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before the scheduled session may result in forfeiture of the deposit.

4.2 Photographer Cancellation: In the event we must cancel due to illness, emergency, or other circumstances beyond our control, we will work with you to reschedule at no additional charge or provide a full refund.

4.3 Weather: For outdoor sessions, we reserve the right to reschedule due to inclement weather. We will work with you to find an alternative date.

5. Image Delivery

5.1 Delivery Time: Final edited images will be delivered within the timeframe specified in your booking agreement, typically 2-4 weeks after the session.

5.2 Delivery Method: Images will be delivered via digital download or other method as specified in your agreement.

5.3 Backup: We recommend downloading and backing up your images immediately upon receipt. We maintain backups for a limited time but are not responsible for permanent storage of your images.

6. Copyright and Usage Rights

6.1 Copyright: All photographs taken by Jake @ Hardwired Visuals are protected by copyright law. The photographer retains copyright to all images.

6.2 Client Usage: Clients receive a license to use the images for personal purposes, including printing, sharing on social media, and personal display. Commercial use requires written permission and may incur additional fees.

6.3 Photographer Usage: We reserve the right to use images for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

7. Client Responsibilities

Clients are responsible for:

Arriving on time for scheduled sessions
Ensuring all participants are present and ready
Following any preparation guidelines provided
Obtaining necessary permissions for location access
Informing us of any special requirements or concerns

8. Limitation of Liability

To the fullest extent permitted by law, Jake @ Hardwired Visuals shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or images. Our total liability shall not exceed the amount paid for the specific session in question.

9. Model Release

By participating in a photography session, you grant Jake @ Hardwired Visuals permission to use your likeness in photographs for portfolio, marketing, and promotional purposes, unless otherwise agreed in writing.

10. Indemnification

You agree to indemnify and hold harmless Jake @ Hardwired Visuals from any claims, damages, or expenses arising from your use of the images, violation of these Terms, or infringement of any rights of another.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
